Is therapy confidential?

In general, therapy sessions are bound by a strict code of confidentiality, ensuring that everything you share with your therapist remains confidential unless you expressly request otherwise. This confidentiality is not just a professional courtesy but a legal requirement that all therapists must adhere to. Information from your sessions cannot be disclosed without your prior written consent.

However, there are specific circumstances where the therapist is legally obliged to breach confidentiality and disclose session information to appropriate authorities or individuals. These situations include:

  1. Suspected Harm to Vulnerable Individuals: If the therapist suspects or becomes aware of abuse towards a child, dependent adult, or an elder, or is informed about domestic abuse, they are mandated by law to promptly notify the relevant law enforcement agencies.
  2. Threat of Severe Bodily Harm: If the therapist has reason to believe that an individual poses a substantial threat of causing severe bodily harm to another person, they are obligated to report this information to the police.
  3. Client’s Intent for Self-Harm or Suicide: In cases where an individual expresses intentions of harming themselves, such as discussing suicide plans, the therapist will make every effort to address these issues within the therapy session. However, if it appears that the issue remains unresolved or the client is uncooperative, further action may be taken to ensure the client’s safety.

These exceptions are in place to prioritize the well-being and safety of all individuals involved, balancing the need for confidentiality with the responsibility to protect those who may be at risk.
